"Man måste nästan vara frisk, för att kunna vara sjuk" : En undersökande studie om sjukförsäkringsreformen, och dess konsekvenser för anställningsskyddet vid sjukdom.

The purpose of this essay is to investigate the Swedish health insurance system, the recent changes in its regulations, and the possible consequences it will have on sick leave and the situation of people that are sick-listed. Different changes, which have been the subject of criticism from various parts of the society, accused of being to strict. Furthermore it discusses the liability and responsibility of the employer, concerning rehabilitation of their employees, which in the end affects the employment security for the employee. The most important change in the Swedish health insurance system is the implementation of rehabkedjan, which stipulates fixed time limits for assessment of a sick-listed person’s ability to work, with the purpose of making sick-listed people return to work in a higher degree than before the changes, since Sweden has a history of prolonged sick leave. The essay also discusses whether the changes being made in the regulations will affect the future rulings of the Swedish Labour Market Court, in cases concerning dismissal based on disease or illness. In addition to this the essay includes a description of the health insurance system in Great Britain, and it also investigates possible differences between men and women in sick leave. The results of this essay points to the fact that little is yet known concerning what effect the changes will have for employers or employees. Despite the fact that the employment security has had no legislative change and therefore is said to be intact, my opinion, and the conclusion of this essay is that in reality it has deteriorated. Keywords: Sick leave, rehabkedjan, health insurance, employers liability, employment security Syftet med den här uppsatsen är att undersöka det svenska sjukförsäkringssystemet, de senaste förändringarna i dess regelverk, samt de eventuella konsekvenser dessa kommer få för sjukskrivning i stort, och situationen för de sjukskrivna. Dessa förändringar har varit föremål för kritik från olika delar av samhället, då de anklagats för att vara för stränga. Vidare diskuteras arbetsgivarens omplacerings- och rehabiliteringsskyldighet, som i slutändan har betydelse för anställningsskyddet för den enskilde. Den viktigaste förändringen i det svenska sjukförsäkringssystemet är införandet av rehabkedjan, som föreskriver fasta tidsgränser för prövning av en sjukskrivens arbetsförmåga, i syfte att få en ökad återgång till arbetslivet. Detta på grund av att Sverige under en lång tid haft en historia av långvariga sjukskrivningar. Uppsatsen diskuterar vidare huruvida dessa förändringar kommer påverka Arbetsdomstolens sätt att döma i frågor gällande uppsägning på grund av sjukdom, i framtiden. Utöver detta innehåller uppsatsen en beskrivning av sjukförsäkringssystemet i Storbritannien som också jämförs med det svenska systemet, och uppsatsen utreder också möjliga skillnader mellan kvinnor och män rörande sjukskrivning. Resultaten i uppsatsen pekar på att det i dagsläget är svårt att utläsa vilken effekt förändringarna kommer få för arbetsgivare och arbetstagare. Trots det faktum att anställningsskyddet inte genomgått någon lagrumsändring och därmed sägs vara intakt, påstår jag, vilket också är uppsatsens slutsats, att anställningsskyddet de facto har försämrats.
